Summary

H.R. 6431 proposes to expand the Self-Employment Assistance (SEA) program by eliminating the requirement that participants be eligible for or exhausted regular unemployment insurance benefits. The bill would broaden approved self-employment activities to include business plans and market feasibility studies submitted by individuals and approved by the state, while mandating weekly certification of such activities. Additionally, the measure raises the cap on the number of individuals participating in SEA programs from 5 to 10.

Why this matters

State workforce agencies currently operating SEA programs under Section 3306(t) should begin reviewing their program eligibility criteria, activity approval processes, and participant monitoring procedures. The weekly certification requirement and expanded activity options will likely require updates to program guidance and participant agreements.

What changed

The amendment to H.R. 6431 modifies Section 3306(t) of the Internal Revenue Code to restructure how states administer self-employment assistance programs. Key changes include removal of the prerequisite that participants must be eligible for regular unemployment compensation, addition of business plan and market feasibility study options as qualifying activities, and implementation of a weekly certification requirement. States would also be permitted to serve twice as many participants under the revised limitation.

State workforce agencies administering SEA programs would need to update their program requirements, verification processes, and participant monitoring systems to align with the new statutory framework. If enacted, states have a 2-year window before the amendments take effect and may voluntarily amend their laws earlier to implement changes.
