Mesothelioma Lump Sum Payments (Amendment) Regulations 2026
Summary
The UK Secretary of State has amended the Mesothelioma Lump Sum Payments (Conditions and Amounts) Regulations 2008. These amendments, effective April 1, 2026, revise the lump sum payment amounts for individuals diagnosed with diffuse mesothelioma and for dependants of deceased individuals, based on age at diagnosis or death.
What changed
The Mesothelioma Lump Sum Payments (Conditions and Amounts) (Amendment) Regulations 2026, effective April 1, 2026, amend the existing 2008 Regulations by substituting revised tables for lump sum payments. These changes alter the payment amounts for individuals diagnosed with diffuse mesothelioma and for their dependants, with the amounts varying based on the age of the affected person at the time of diagnosis or death. The amendments apply to new diagnoses or claims made on or after April 1, 2026, or to dependants of individuals who die on or after that date.
Compliance officers should review the updated payment tables to ensure accurate calculations for new claims filed on or after April 1, 2026. The specific age-based payment amounts have been significantly revised, and it is crucial to apply the correct table based on the individual's age at diagnosis or death, or the claim date if diagnosis is unknown. The regulations extend to England, Wales, and Scotland.
What to do next
- Review updated lump sum payment tables for mesothelioma claims.
- Apply revised payment amounts for diagnoses or claims made on or after April 1, 2026.
- Ensure correct application of tables for dependants of individuals who die on or after April 1, 2026.

Explanatory Note
(This note is not part of the Regulations)
These Regulations amend the Schedule to the Mesothelioma Lump Sum Payments (Conditions and Amounts) Regulations 2008 (S.I. 2008/1963) (“ the 2008 Regulations ”) by substituting revised tables specifying the amount of lump sum payments payable to people with diffuse mesothelioma or to their surviving dependants.
The substituted tables have the effect of increasing the amounts payable under the 2008 Regulations by 3.8 per cent in each case, rounded up or down to the nearest £1 as appropriate.
The amendments made by these Regulations will apply in respect of a claim—
- by a person who was first diagnosed with diffuse mesothelioma on or after 1st April 2026,
- made on or after 1st April 2026 by a person with diffuse mesothelioma where the date of the diagnosis is unknown, or
- by a dependant of a person who died on or after 1st April 2026 and who, immediately before their death, had diffuse mesothelioma. A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
