Fertility Preservation Insurance Coverage Mandate
Summary
Illinois Governor signed SB1259 into law, mandating that all individual and group accident and health insurance policies amended, delivered, issued, or renewed after June 1, 2026 provide coverage for standard fertility preservation services and follow-up care. The bill applies to policies under the Illinois Insurance Code, State Employees Group Insurance Act, Counties Code, Municipal Code, School Code, HMO Act, Limited Health Service Organization Act, and Illinois Public Aid Code.
What changed
Illinois enacted Senate Bill 1259, which amends the Illinois Insurance Code and multiple related statutes to require health insurance coverage for standard fertility preservation services. The coverage mandate applies to policies amended, delivered, issued, or renewed after June 1, 2026. Standard fertility preservation services are defined as procedures based upon evidence-based standards of care established by the American Society for Reproductive Medicine, American Society of Clinical Oncology, or other national medical associations. The bill makes conforming changes across eight Illinois statutes covering state employee insurance, county and municipal plans, school district benefits, HMO and limited health service organization regulations, and public aid programs.
Health insurers, self-insured employers, and state agency health plans in Illinois must update policy documents, claims processing systems, and provider networks to incorporate fertility preservation coverage before the June 1, 2026 effective date. Carriers offering individual and group health insurance products should begin policy revision processes immediately to ensure compliance with the new mandatory benefit. The law provides approximately 17 months for implementation.
What to do next
- Review all health insurance policy forms and amend to include fertility preservation coverage effective June 1, 2026
- Update claims processing systems and provider reimbursement procedures for fertility preservation services
- Notify policyholders of new fertility preservation coverage benefit in upcoming renewal materials
