Illinois HB5184: Amends Landlord Tenant Act regarding eviction records
Summary
Illinois House Bill 5184, introduced in the 104th General Assembly, proposes to amend the Landlord and Tenant Act. The bill seeks to seal eviction proceedings if the tenant has complied with the terms of their lease regarding rent payments. The bill has been filed and referred to committee.
What changed
Illinois House Bill 5184, introduced in the 104th General Assembly, proposes an amendment to the Landlord and Tenant Act. Specifically, it mandates that eviction proceedings be sealed if the trier of fact determines the tenant has met all lease terms concerning the amount and timeliness of rent payments. This change aims to protect tenants who have fulfilled their rental obligations from having eviction records permanently impact their housing prospects.
This bill is currently in the draft stage, having been filed and referred to the House Rules Committee. Compliance officers in property management or legal departments overseeing landlord-tenant relations in Illinois should monitor the progress of this bill. If enacted, it will require updates to internal procedures for handling eviction case outcomes and record sealing requests, potentially impacting tenant screening processes and legal defense strategies.
