Summary

The FCC is seeking comments on an extension of an existing information collection activity related to frequency coordinator notification requirements. This notice is part of the FCC's effort to reduce paperwork burdens under the Paperwork Reduction Act. Comments are due by May 18, 2026.

What changed

The Federal Communications Commission (FCC) has issued a notice and is requesting comments on an extension of an existing information collection activity, specifically concerning Section 90.176, which details Coordinator Notification Requirements on certain frequencies. This action is part of the FCC's ongoing efforts to reduce paperwork burdens as mandated by the Paperwork Reduction Act (PRA) of 1995. The specific collection, identified by OMB Control Number 3060-0783, involves requirements for Private Land Mobile frequency coordinators to provide listings and engineering analyses of frequency recommendations. The FCC is seeking input on the necessity, utility, accuracy of burden estimates, and potential methods to minimize the burden on respondents, particularly small businesses.

Regulated entities, specifically business or other for-profit respondents involved in frequency coordination, should review the details of the information collection and submit comments by May 18, 2026. The FCC is particularly interested in feedback regarding ways to enhance the quality and utility of the information collected and minimize the burden. While this is a consultation for an extension of an approved collection, failure to comply with PRA requirements, such as displaying a valid OMB control number, can result in penalties. The FCC intends to submit this collection for a full three-year clearance after the comment period.

What to do next

  1. Submit comments on the proposed information collection by May 18, 2026.
  2. Review Section 90.176 regarding Coordinator Notification Requirements.
  3. Advise FCC contact if unable to submit comments within the specified period.

Penalties

No person shall be subject to any penalty for failing to comply with a collection of information subject to the PRA that does not display a valid Office of Management and Budget (OMB) control number.

ACTION:

Notice and request for comments.

SUMMARY:

As part of its continuing effort to reduce paperwork burdens, and as required by the Paperwork Reduction Act (PRA) of 1995,
the Federal Communications Commission (FCC or the Commission) invites the general public and other Federal agencies to take
this opportunity to comment on the following information collection. Comments are requested concerning: whether the proposed
collection of information is necessary for the proper performance of the functions of the Commission, including whether the
information shall have practical utility; the accuracy of the Commission's burden estimate; ways to enhance the quality, utility,
and clarity of the information collected; ways to minimize the burden of the collection of information on the respondents,
including the use of automated collection techniques or other forms of information technology; and ways to further reduce
the information collection burden on small business concerns with fewer than 25 employees. The FCC may not conduct or sponsor
a collection of information unless it displays a currently valid control number. No person shall be subject to any penalty
for failing to comply with a collection of information subject to the PRA that does not display a valid Office of Management
and Budget (OMB) control number.

DATES:

Written PRA comments should be submitted on or before May 18, 2026. If you anticipate that you will be submitting comments,
but find it difficult to do so within the period of time allowed by this notice, you should advise the contact listed below
as soon as possible.

ADDRESSES:

Direct all PRA comments to Nicole Ongele, FCC, via email PRA@fcc.gov and to nicole.ongele@fcc.gov.

SUPPLEMENTARY INFORMATION:

OMB Control Number: 3060-0783.

Title: Section 90.176, Coordinator Notification Requirements on Frequencies Below 512 MHz or at 769-775/799-805 MHz or at 1427-1432
MHz.

Obligation to Respond: Required to obtain or retain benefits. Statutory authority for this information collection (IC) is contained in sections 47
U.S.C. 154(i), 161, 303(g), 303(r) and 332(c)(7) of the Communications Act of 1934, as amended.

Section 90.176 requires each Private Land Mobile frequency coordinator to provide, within one business day, a listing of their
frequency recommendations to all other frequency coordinators in their respective pool, and if requested, an engineering analysis.

Any method can be used to ensure this compliance with the “one business day requirement” and must provide, at a minimum, the
name of the applicant; frequency or frequencies recommended; antenna locations and heights; and effective radiated power;
the type(s) of emissions; the description of the service area; and the date and time of the recommendation. If a conflict
in recommendations arises, the effected coordinators are jointly responsible for taking action to resolve the conflict, up
to and including notifying the Commission that an application may have to be returned.

This requirement seeks to avoid situations where harmful interference is created because two or more coordinators recommend
the same frequency in the same area at approximately the same time to different applicants.

Federal Communications Commission.
