Summary

The Colorado General Assembly passed HB26-1398 to adjust the allocation of retail delivery fee revenue from the multimodal transportation and mitigation options fund. Currently, 85% of fund revenue is allocated to the commission for local multimodal projects and 15% to state multimodal projects. Beginning July 1, 2026, the allocation changes to 70% for local projects and 30% for state projects. The bill was introduced by Representative Kyle Brown, Representative Emily Sirota, Senator Judy Amabile, and Senator Barbara Kirkmeyer, and passed both chambers with final Senate approval on April 16, 2026.

What changed

HB26-1398 modifies the allocation formula for retail delivery fee revenue credited to the multimodal transportation and mitigation options fund. The bill increases the state share from 15% to 30% while decreasing the local share from 85% to 70%, effective July 1, 2026. This represents a 100% increase in state-level multimodal project funding from this source.

Affected parties include the Colorado Department of Transportation commission responsible for multimodal projects, local government transportation authorities receiving multimodal allocations, and any entities collecting or remitting the retail delivery fee. The reallocation may affect project prioritization and funding availability at both local and state levels, potentially requiring coordination between state and local transportation agencies to adjust capital improvement planning.
