Summary

Colorado bill HB26-1364 proposes an alternative method for calculating the 2025 Consumer Price Index (CPI). The Bureau of Labor Statistics (BLS) failed to determine the CPI for October 2025 and calculated the annual CPI using only 11 months, over-weighting the first half of 2025. The bill would instead average the two semi-annual BLS CPI determinations for 2025, giving equal weight to both halves of the year.

What changed

The bill addresses a data gap in BLS CPI calculations for 2025 where October data was unavailable. Current law would use an average of 11 monthly CPI values (January-September and November-December 2025), effectively weighting the first half of 2025 more heavily. HB26-1364 proposes averaging the two semi-annual BLS CPI determinations instead, treating each half-year equally.

For affected parties, this change primarily impacts state fiscal calculations tied to CPI, including certain tax bracket adjustments and budget projections. The bill applies only to 2025 CPI calculations and includes an appropriation. Government agencies, insurers, and employers with contracts or obligations linked to CPI adjustments should monitor this legislation as it moves through the House Appropriations Committee.

What to do next

  1. Monitor HB26-1364 as it progresses through the Colorado legislature
  2. Review fiscal impact on tax calculations if bill is enacted

Recent Bill (PDF) Recent Fiscal Note (PDF) Bill Summary:

Joint Budget Committee. The United States bureau of labor statistics (BLS) determines the consumer price index (CPI) for each month. At the end of a year, the BLS determines the CPI for that year by averaging the CPI for each month in the year. However, as of March 2026, the BLS did not determine the CPI for the month of October and then determined inflation for 2025 by averaging the CPI for every month besides October in 2025. The BLS's approach to determining the CPI for 2025 overweighted the CPI of the first half of 2025 relative to the second half of 2025, since the BLS included each month from the first half of 2025 and only 5 of the 6 months in the second half of 2025, in determining the CPI for 2025.

The bill, for 2025 only, determines the CPI for 2025 by averaging the 2 semi-annual BLS CPI determinations for 2025. This approach gives equal weight to the CPI from the first and second halves of 2025.
