New Mexico DOJ Halts Business Illegally Filing Liens on Residences
Summary
The New Mexico Department of Justice has halted Boreworxx Construction, LLC from illegally filing liens on nearly 200 Albuquerque residences. The company's operator, Jeffery Dailey, has released the liens and agreed to cease future misconduct as part of an Assurance of Discontinuance.
What changed
The New Mexico Department of Justice (NMDOJ) has taken enforcement action against Boreworxx Construction, LLC and its operator, Jeffery Dailey, for illegally filing nearly $2 million worth of liens on approximately 200 residential properties in Albuquerque. The liens were allegedly used as a scare tactic to coerce homeowners into complaining about a contract dispute with Boreworxx's client, Circet USA, over fiber optic installation work. The NMDOJ's investigation led to an Assurance of Discontinuance (AOD) agreement, requiring Boreworxx and Dailey to release the liens, cease direct communication with affected homeowners, provide a list of all individuals contacted regarding the liens to the NMDOJ, and preserve all related documents.
Affected homeowners will be notified that the liens have been removed. The agreement prohibits Boreworxx and Dailey from future misconduct of this nature. The NMDOJ encourages any individuals affected by this case to file a complaint. This action highlights the importance of prompt reporting of alleged abusive business practices to regulatory authorities to prevent further harm to consumers and resolve contract disputes appropriately.
What to do next
- Review Assurance of Discontinuance agreement for Boreworxx Construction, LLC and Jeffery Dailey.
- Ensure all affected homeowners are notified of lien removal.
- Report any further instances of illegal lien filing or abusive business practices to the NMDOJ.
Penalties

New Mexico Department of Justice Halts Business Illegally Filing Liens on Nearly 200 Albuquerque Residences
- August 20, 2025
Boreworxx Construction, LLC illegally filed nearly $2 million worth of liens on homes in attempt to manipulate its contract company into paying for fiber work that allegedly was not completed satisfactorily.
Albuquerque, NM – The New Mexico Department of Justice has reversed the issuance of liens on nearly 200 residential properties in Albuquerque after a local subcontractor, Boreworxx Construction, LLC, filed the illegal liens in an attempt to frighten and manipulate homeowners. Following the NMDOJ’s investigation, Boreworxx operator Jeffery Dailey has released the liens and is prohibited from future misconduct.
The NMDOJ’s investigation revealed that the liens were part of a scare tactic aimed at coercing homeowners to complain in an effort to get Boreworxx paid for fiber optic installation work that allegedly was not competed satisfactorily.
Boreworxx Construction, LLC was contracted by Circet USA to complete work on a project that aims to improve internet services in the City of Albuquerque in city-owned rights of way. Upon discovery of work alleged to be performed unsatisfactorily, Circet USA refused to pay the contract balance prompting Boreworxx to issue the illegal liens.
“We will not tolerate abusive scare tactics or unethical behavior by businesses in this community,” said Attorney General Raúl Torrez. “Prompt reporting of this issue by both members of the community and the City of Albuquerque, enabled our office to take action and stop this company from holding homeowners hostage and using them as a bargaining chip in their ongoing contract dispute.”
In addition to ceasing to claim liens and not claiming additional liens, the Assurance of Discontinuance (AOD) agreement stipulates Dailey and Boreworxx:
- Shall discontinue communicating directly or indirectly with homeowners who previously received correspondence regarding the liens
- Shall promptly provide to the NMDOJ a comprehensive list of all individuals that have received correspondence regarding the liens
- Shall not delete, modify, lose, alter or destroy any documents or electronically stored information which relates to the subject matter Copy of Assurance of Discontinuance (AOD)
Homeowners who have been affected by this case will be notified that the lien has been removed and that there is no lien on their home.
Anyone that has been affected by this case is encouraged to reach out to the NMDOJ and file a complaint via https://nmdoj.gov/get-help/submit-a-complaint/.
