D efendant Kelly McEachran, the former Hope Christian teacher charged with allegedly sexually abusing his students, appealed the district court’s decision to detain him until trial. After the New Mexico Department of Justice (NMDOJ) responded to the appeal, the New Mexico Court of Appeals upheld the ruling. The defendant then petitioned for the New Mexico Supreme Court to hear the case and, after the NMDOJ filed its response, the New Mexico Supreme Court agreed last week not to hear the case. Although there has not been a trial and the defendant is presumed to be innocent until proven guilty, the charges are very serious. The defendant remains detained pending the next stage of the case.

“We applaud the decision of both the New Mexico Court of Appeals and the New Mexico Supreme Court upholding the detention order against this former teacher who is accused of rape and child sex abuse,” said Attorney General Raúl Torrez. “These are serious charges and my office will not tolerate abuse against our children. The defendant was in a position of power and is accused of taking advantage of that power to sexually abuse his students. After his arrest in Idaho, we are pleased that he will remain in jail here in New Mexico to face the horrific charges against him. The welfare of our children is the utmost priority of the New Mexico Department of Justice, and we will continue to work with local law enforcement agencies to see this case through.”
