HB5408 Updates Abortion Access Fund Grants Program
Summary
Illinois HB5408 was signed into law by the Governor on April 9, 2026, amending the Abortion Access Fund Grant Program. The bill removes Department of Public Health rulemaking and disclosure requirements, and redirects specified moneys to be remitted to the Department of Insurance for deposit into the Abortion Access Fund rather than transferred directly. The legislation takes effect immediately upon signing.
What changed
HB5408 modifies the Abortion Access Fund Grant Program by replacing references to "abortion care services" and "abortion services" with "abortions." The bill removes provisions requiring the Department of Public Health to establish rules and disclosure requirements for the program. Additionally, the legislation changes the fund flow mechanism by requiring specified moneys to be remitted to the Department of Insurance (rather than transferred directly to the Abortion Access Fund), with all such moneys required to be deposited into the Abortion Access Fund.
Healthcare providers and organizations participating in or seeking to participate in the Abortion Access Fund Grant Program should review the amended program requirements. Grant applicants and recipients should monitor for updated guidance from the Department of Insurance regarding the new remittance procedures and any revised program eligibility or reporting requirements.
What to do next
- Review updated grant program requirements under HB5408
- Monitor Illinois Department of Insurance for implementing guidance
- Ensure compliance with new fund remittance procedures
