Summary

Kentucky General Assembly enacted HB184 to limit health insurance cost-sharing requirements that would cause policies to lose HSA-qualified status under federal law. The bill creates new sections in KRS Chapter 304 and KRS Chapter 18A and may be cited as the Health Savings Account State-Federal Regulatory Coordination Model Act. The legislation passed with unanimous votes in both chambers (94-0 House, 38-0 Senate) and was signed by the Governor on April 3, 2026.

What changed

HB184 creates a new section of KRS Chapter 304 establishing limitations on cost-sharing requirements that would disqualify health insurance policies from HSA-qualified status under federal law. The bill also creates a new section of KRS Chapter 18A subjecting state employee benefit cost-sharing to the same limitations. The Act applies to all policies, certificates, plans, and contracts issued or renewed on or after its effective date.

Health insurers offering HSA-qualified plans in Kentucky must review their cost-sharing structures to ensure compliance with the new state limitations. State agencies administering KRS Chapter 18A benefits must update plan designs accordingly. Insurance brokers and advisers should assess affected client portfolios for compliance with the new requirements. The bill received strong bipartisan support with unanimous passage in both chambers.

What to do next

  1. Review HSA-qualified health insurance plan designs for compliance with new cost-sharing limitations
  2. Update state employee benefit plans under KRS Chapter 18A to align with new requirements
  3. Assess whether existing policy cost-sharing structures would trigger loss of HSA-qualified status
