                                  ORDER 1.     By this Original Application (OA), the Applicant has claimed

compensation under Sections 15 and 17 of the National Green Tribunal

Act, 2010.

  1. Plea of the Applicant is that the family members i.e. daughter, wife,

brother and mother of the applicants have died in massive explosion on

23.09.2023 in an illegal fire cracker manufacturing unit operating in a

house near Pani in Tanki, Police Chowki, Roop Nagar, PS Loni, District

Ghaziabad, Uttar Pradesh.

  1. The Applicant alleges that the fire cracker unit was operating illegally

and in the said accident following seven persons had died:-

"a) Alisha D/o Shakeel Aged 15 years (Daughter of Applicant no.1)

b) Aleena D/o Shakeel aged 12 years (Daughter of Applicant
no.1).

c) Saeestaa W/o Shakeel aged 37 years (Wife of Applicant 5 no.1)

d) Noori W/o Jafir (Daughter of Applicant no.2 (Mother))

e) Geeta Devi W/o Sonu aged 30 years (Daughter of Applicant no.3
(Mother)) [Husband Sonu is predeceased]

f) Imran S/o Firoz Khan aged 15 years (Brother of Applicant no.4)
[Father Firoz is predeceased]

g) Mabeesh Khan W/o Firoz Khan aged 39 years (Mother of
Applicant no.4) [Father Firoz is predeceased]."
4. Learned counsel appearing for the Applicant has referred to the FIR

dated 24.09.2023 (Annexure A2) and has submitted that the accident was

immediately reported to the Police Station and in the FIR details of the

incident and illegal operation of the unit were also recorded. He has further

referred to the post marten report of the deceased (Annexure A-3) in

support of the plea that death has taken place in the fire accident. He has

also relied upon the RTI reply dated 07.02.2026 given by the UP PCB in

response in his RTI application dated 16.01.2026 and has submitted that

as per the said reply fire cracker unit did not have the requisite

environmental clearances from the UP PCB. He has further referred to the

RTI reply dated 07.02.2026 given by the office of the District Magistrate in

response to his RTI Application dated 16.01.2026 and has submitted that

the unit was not having the requisite license under the [Explosives Act,

unit. He has also submitted that a representation dated 29.11.2025 was

submitted to the District Magistrate, Ghaziabad but till now no

compensation has been paid to the Applicant.

  1. Learned counsel for the Applicant has pointed out that Tribunal in

similar circumstances by order dated 18.04.2023 passed in OA No.

271/2023 had granted environmental damage compensation and against

this order Civil Appeal Dairy No. 1331/2023 has been dismissed by the

Hon'ble Supreme Court by order dated 27.02.2026 on the ground of delay

as well as on merit.

  1. Issue notice to the Respondents. The Applicant is directed to serve

the Respondents and file affidavit of service atleast one week before the

next date of hearing.
