ORDER 1. The applicant filed present application under Section 18 (1) read
with Section 14(1) and 15(1) of the National Green Tribunal Act, 2010.
- Vide order dated 18.05.2023, notices were issued to the
respondents.
- Pursuant thereto, replies/reports were filed by the respondents
which have been taken on record.
- In the course of hearing, it was pointed out that [Civil Appeal
No.2480/2023 the Poultry Farmers and Breeding Association Vs. Union of
India & Ors.](https://indiankanoon.org/doc/121919953/) involving the same issue as involved in the present Original
Application is pending before the Hon'ble Supreme Court of India.
- Learned Counsels for the parties have conceded that the decision
of the abovesaid Civil Appeal will have material bearing on the decision of
the present Original Application.
- This Tribunal has already adjourned the case for more than eleven
dates in view of the pendency of the above said Civil Appeal.
- Disposal of the above said Civil Appeal is likely to take some time.
No useful purpose will be served by repeatedly adjourning the matter
during pendency of the abovesaid Civil Appeal. No prejudice will be
caused to the parties if the present Original Application is adjourned sine
die as any of the parties may move this Tribunal for revival thereof.
- Accordingly, the present Original Application is adjourned sine die
with liberty that any of the parties may move this Tribunal for revival
thereof after decision of the abovesaid Civil Appeal by the Hon'ble
Supreme Court of India.
- Appropriate entry be made in the record that the abovementioned
Original Application has been adjourned sine die and will be revived for
further hearing after decision of the abovesaid Civil Appeal by the Hon'ble
Supreme Court of India.
