S S Kumar vs CEO, Kolkata Metropolitan Development Authority - Adjournment Sine Die
Summary
The National Green Tribunal (NGT) has adjourned Original Application No. 119/2024/EZ sine die. The adjournment is pending the decision of a related writ petition (W.P.A. (P) No.274 of 2024) before the Hon'ble Calcutta High Court, as its outcome will materially affect the NGT case.
What changed
The National Green Tribunal (NGT) has adjourned the Original Application No. 119/2024/EZ, filed by S S Kumar against the Chief Executive Officer of the Kolkata Metropolitan Development Authority and others, sine die. This decision was made because a related writ petition (W.P.A. (P) No.274 of 2024) concerning the same issues is pending before the Hon'ble Calcutta High Court, and its resolution is expected to significantly influence the NGT's case.
No immediate action is required from regulated entities as this is an adjournment of a judicial proceeding. The parties have been granted liberty to move the Tribunal for revival of the application after the High Court's decision on the writ petition. This action does not impose new obligations or penalties but reflects a procedural step in ongoing litigation.
