                              ORDER 1.    The applicant filed present application under Section 18 (1) read

with Section 14, 15 and 17 of the National Green Tribunal Act, 2010.

which are taken on record.

  1. In the course of hearing, it was pointed out that W.P.A. (P) No.274

of 2024 titled Sabuj Manch represented by its Secretary Naba Kumar

Dutta & Anr. vs. The Kolkata Municipal Development Authority & Ors.

involving the same issue as involved in the present Original Application is

pending before the Hon'ble Calcutta High Court.

  1. Learned Counsels for the respondents have conceded that the

decision of the abovesaid W.P.A. (P) No.274 of 2024 titled Sabuj Manch

represented by its Secretary Naba Kumar Dutta & Anr. vs. The Kolkata

Municipal Development Authority & Ors. will have material bearing on the

decision of the present Original Application.

  1. This Tribunal has already adjourned the case for more than four

dates in view of the pendency of the above said Writ Petition.

  1. Disposal of the above said Writ Petition is likely to take some time.

No useful purpose will be served by repeatedly adjourning the matter

during pendency of the abovesaid Writ Petition. No prejudice will be

caused to the parties if the present Original Application is adjourned sine

die with liberty that any of the parties may move this Tribunal for revival

thereof.

with liberty that any of the parties may move this Tribunal for revival

thereof after decision of the abovesaid Writ Petition by Hon'ble Calcutta
