ORDER 1. The applicant filed Original application No. 112/2021/EZ which
was disposed of vide order dated 07.02.2023 with direction to the District
Magistrate, Sundergarh to file compliance report within three months.
- Since report was not filed by the District Magistrate, Sundergarh
as directed above, the matter was listed before the Bench by Registry
M.A. No. 06/2024/EZ.
- Vide order dated 14.02.2024, notices were issued to the
respondents.
- Compliance affidavit dated 23.03.2024 was filed by the
Collector/District Magistrate, Sundergarh.
- In the course of hearing, it was pointed out that Writ Petition (Civil)
No. 6077/2023, M/s KMC RKD (Joint Venture) vs. State of Odisha & Ors. is pending before the Hon'ble High Court of Orissa.
- Learned Counsels for the parties have conceded that the decision
of the abovesaid Writ Petition will have material bearing on the decision
of the present Miscellaneous Application.
- This Tribunal has already adjourned the case for more than ten
dates in view of the pendency of the above said Writ Petition.
- Disposal of the above said Writ Petition is likely to take some time.
No useful purpose will be served by repeatedly adjourning the matter
during pendency of the abovesaid Writ Petition. No prejudice will be
caused to the parties if the present Miscellaneous Application is
adjourned sine die as any of the parties may move this Tribunal/the
Registry may list the matter for revival thereof after decision of the
abovesaid Writ Petition by Hon'ble High Court of Orissa
- Accordingly, the present Miscellaneous Application is adjourned
sine die with liberty that any of the parties may move this Tribunal/the
Registry may list the matter for revival thereof after decision of the
