Summary

The National Green Tribunal (Eastern Zone Bench, Kolkata) adjourned Miscellaneous Application No. 06/2024/EZ in Original Application No. 112/2021/EZ sine die. The adjournment is pending the decision of Writ Petition (Civil) No. 6077/2023 before the Hon'ble High Court of Orissa, as its outcome will materially affect the present application.

What changed

The National Green Tribunal has adjourned Miscellaneous Application No. 06/2024/EZ, filed in Original Application No. 112/2021/EZ, sine die. This decision was made because a related Writ Petition (Civil) No. 6077/2023 is pending before the Hon'ble High Court of Orissa, and its resolution is expected to significantly impact the current proceedings. The Tribunal noted that repeated adjournments would serve no useful purpose while the High Court case is ongoing.

Parties involved in the Miscellaneous Application should be aware that the matter will not proceed further until the High Court of Orissa decides the aforementioned Writ Petition. Any party can move the Tribunal or the Registry to relist the matter for revival after the High Court's decision. No immediate compliance actions are required for this specific application, but parties should monitor the progress of the related Writ Petition.

What to do next

  1. Monitor the decision of Writ Petition (Civil) No. 6077/2023 before the Hon'ble High Court of Orissa.
  2. File a motion to relist the Miscellaneous Application after the High Court decision, if necessary.
