ORDER 1. Learned Senior Counsel for the State of Punjab has referred to the
documents filed alongwith IA No. 226/2026 and has submitted that the
same issue is pending before the Punjab and Haryana High Court.
- Learned Counsel for the Applicant has pointed out that IA No.
226/2026 has been filed by the Respondents No. 3 to 9 - State of Punjab
and its authorities supported by affidavit of one Amrinder Singh Pandher
dated 06.03.2026 whereas in the IA the averment concerning the date of
hearing of 23.03.2026 have been made.
- Learned Senior Counsel for the State of Punjab submits that by
mistake wrong affidavit has been filed with the IA and correct affidavit will
be filed during the course of the day.
- Learned Counsel for the Applicants has raised the further issue that
in Civil Appeal No. 2493/2026 before the Hon'ble Supreme Court the plea
was taken by the State of Punjab that the same issue is pending before the
Punjab and Haryana High Court in CWP PIL No. 184/2025, therefore, by
filing this OA the applicant is attempting for forum shopping. He has
referred to the plea in paragraph 2(1)(c) of the IA No. 226/2026 and the
plea is taken that out of 85 sites, no site overlaps with CWP PIL No.
184/2025. He submits that the SLP was supported by the affidavit of
Amrinder Singh Pandher. The same officer who has filed the affidavit before
the Tribunal in IA No. 226/2026, but he is not the respondent in the OA.
Therefore, even the action for giving the incorrect affidavit cannot be taken
against him and the pleadings are not supported by the affidavit of the
proper respondent. Learned Counsel for the State is permitted to look into
this issue and respond on the next date of hearing. 2
