Applicant: None for the applicant.
ORDER 1. One Mr. Devendra Sharma-complainant has sent us representation
dated 06.10.2025 against M/s Sumit, Proprietor through Shri Pramod
Sharma, who is involved in running illegal plastic manufacturing unit
within residential colony of Indrapuri, Patna without obtaining Consent
to Establish and Consent to Operate from the State Pollution Control
Board. The unit engages in thermal processing of plastic granules,
generating toxic fumes, particulate matters and high-decibel noise,
thereby causing severe air and noise pollution. The activity is being run
contrary to the siting criteria as well.
- The complainant had made a complaint to the State Pollution
Control Board on 20.10.2021, whereon the State Pollution Control Board
had issued proposed direction for closure on 06.02.2024 and later on a
Closure Order was issued on 31.07.2024. But despite that order, the
Project Proponent resumed the operations in April, 2025 in open
defiance. Therefore, this application has been moved with a prayer that
respondent/proponent directed to permanently close the illegal 1 hazardous plastic manufacturing factory and his premises should be
ordered to be sealed.
- The substantial question pertaining to environment has been made
out, therefore, we direct the Registry to implead M/s Sumit, Proprietor:
Shri Pramod Sharma as respondent no.1; Bihar State Pollution Control
Board as respondent no.2 and issue notices to them, returnable within
four weeks by all the modes.
- From the side of respondent no.2-Bihar State Pollution Control
Board, Ms. Amrita Pandey, learned counsel has already put in
appearance, hence, notice is dispensed with.
Despite repeated calls, the applicant has not appeared today.
Put up this matter for next consideration on 07.05.2026.
