What changed
The Kentucky PSC granted Sierra Club's motion to admit Kristin Henry and Nathaniel Shoaff, California-based attorneys, to appear pro hac vice before the Commission in Case No. 2026-00001, an application by Kentucky Power Company for a certificate of public convenience and necessity and related approvals. The attorneys demonstrated good standing in their home state bar and certification by the Kentucky Bar Association under Supreme Court Rule 3.030(2), and agreed to submit to Commission and KBA jurisdiction.
Affected parties in similar proceedings before the Kentucky PSC should note that out-of-state environmental counsel may participate through pro hac vice admission provided they associate with a Kentucky-licensed attorney who maintains co-counsel status and physical presence at all proceedings. The order does not impose new compliance obligations on regulated utilities or other parties beyond the case-specific procedural requirements.
