Proposed Modifications to Electricity Interconnector Licence Conditions 26A and 26B
Summary
Ofgem is consulting on proposed amendments to Standard Licence Conditions 26A and 26B of the electricity interconnector licence. The modifications address the definition of Pre-Operational Force Majeure under Condition 26A and the definition of Backstop date under Condition 26B, both relating to delays in the Regime Start Date caused by qualifying events. Responses are invited by 20 May 2026 via email.
“This consultation seeks to amend the definition of Pre-Operational Force Majeure definition as defined in Standard Licence Condition 26A.”
Interconnector operators, particularly those in the Third Window or with projects potentially subject to Pre-operational Force Majeure claims, should review the proposed definitions carefully. Changes to the Backstop date definition in Condition 26B could affect the timeline for when the regulatory regime becomes operative for their projects. Operators should submit responses by 20 May 2026.

What changed
Ofgem proposes amendments to two standard conditions of the electricity interconnector licence: Standard Licence Condition 26A (Delay to Regime Start Date caused by Pre-operational Force Majeure) and Standard Licence Condition 26B (Delay to Regime Start Date caused by Pre-operational Force Majeure for the Third Window). The consultation specifically seeks input on revising the definition of Pre-Operational Force Majeure in Condition 26A and the definition of Backstop date in Condition 26B.
Electricity interconnector licence holders and interested stakeholders should review the proposed changes and submit responses by 20 May 2026. Operators with Third Window projects or those potentially affected by Force Majeure provisions should assess how the revised definitions may impact their regime start date calculations and obligations.
