COMMONWEALTH OF KENTUCKY BEFORE THE PUBLIC SERVICE COMMISSION In the Matter of:
O R D E R On November 5, 2025, Kenergy Corp. (Kenergy) filed an application pursuant to KRS 278.018(6) for approval of an agreement with Kentucky Utilities Company (KU) to change certified territory boundaries. The application did not include a map and site plan of the service territory that is the subject of the application in the format required by Commission Staff to update electric service area maps. As a result, on March 13, 2026, Commission Staff served requests on Kenergy for required information. Kenergy filed the requested information on March 26, 2026. The proposed exchange would allow KU to provide new electric service to a
property in Owensboro, Kentucky, that is currently located in Kenergy's service territory.
No existing customers will be impacted by the proposed exchange. This matter now stands ripe for a decision. LEGAL AUTHORITY KRS 278.016 divided the state into exclusive electric service territories to (1) promote the orderly development of retail electric service; (2) avoid wasteful duplication; (3) avoid unnecessary encumbering of the landscape; (3) prevent the waste of materials

and natural resources; and (5) for the public convenience and necessity, minimize disputes between retail electric suppliers. KRS 278.018(6) allows a jurisdictional electric utility to contract with another retail electric supplier, subject to Commission approval, to change service territory boundaries. The Commission is required to approve such a contract if it finds that the contract will promote the purposes of KRS 278.016 and will provide adequate and reasonable service to all areas and consumers affected thereby. DISCUSSION
Kenergy's certified service territory includes a tract of approximately 9.775 acres
of land at 5200 Highway 2830, Owensboro, Kentucky, 42303, that is owned by Barr Media LLC (Barr Meida). Kenergy stated in its application that it recently received a request for new services at the property from Barr Media and determined that it would be required to undertake substantial expense and effort to extend its facilities to serve the new customer. Specifically, Kenergy stated that it would be required to extend its existing distribution system approximately 838 feet to the Barr Media property. The extension would also
cross a rail line and would require KU to change a pole to allow clearance for Kenergy's
extension. Kenergy stated that KU already has existing facilities on an immediately adjacent tract of land to the south of the Barr Media property and can extend its service with
substantially less expense and effort than Kenergy. Specifically, KU's extension would
be 590 feet and would not require the rail line to be crossed. Kenergy stated that in exchange for the Barr Media property, it will receive a tract of approximately 10.69 acres of land on the opposite side of Highway 2830. KU currently

has 1 customer in the area Kenergy is receiving that will be excepted from the exchange and remain in KU territory. Kenergy asserted that this exchange would serve the purposes of KRS 278.016 and should be approved. Based on the record, the Commission finds that the agreement between Kenergy and KU for an exchange of certified service territory will promote the purposes of KRS 278.016. The proposed change in service territory boundaries is consistent with the orderly development of retail electric services, will not result in the wasteful duplication of distribution facilities, and will avoid unnecessary encumbrance of the landscape of the Commonwealth of Kentucky. The Commission therefore finds that the agreement between Kenergy and KU should be approved. IT IS THEREFORE ORDERED that:

approved.This case is closed and removed from the Commission's docket.
