Summary

The Federal Energy Regulatory Commission (FERC) has instituted a Section 206 proceeding against ISO New England Inc. (ISO-NE) to investigate its Transmission, Markets and Services Tariff. The proceeding will determine if the tariff is unlawful due to a lack of provisions for correcting erroneous payments or charges to market participants.

What changed

FERC has initiated an investigation under Section 206 of the Federal Power Act (FPA) into ISO New England Inc.'s (ISO-NE) Transmission, Markets and Services Tariff. The proceeding, identified under Docket No. EL26-45-000, aims to determine if the tariff is unjust, unreasonable, or otherwise unlawful because it lacks mechanisms to correct improper or erroneous payments or charges to market participants. The refund effective date will be the date of publication in the Federal Register.

Interested parties must file a notice of intervention or motion to intervene within 21 days of the order's issuance. Regulated entities and market participants should review the tariff provisions related to payment corrections and consider filing to be heard in the proceeding. Failure to intervene may affect their ability to influence the outcome or seek redress for past erroneous payments.

What to do next

  1. File notice of intervention or motion to intervene within 21 days of March 10, 2026, if desiring to be heard.
  2. Review ISO New England's Transmission, Markets and Services Tariff for provisions related to payment corrections.
  3. Monitor FERC's Federal Register publication for the refund effective date.
