La AAIP, en su carácter de Autoridad de Aplicación de la Ley N° 25.326 de Protección de Datos Personales, inició una investigación para determinar la existencia de presuntos incumplimientos en el marco de gestiones de cobranza por parte de la empresa 5 ON LINE S.R.L. Las denuncias que motivaron la investigación refieren a prácticas que podrían implicar transgresiones a la Ley, en el marco del tratamiento ilegítimo de datos de personas registradas como deudoras.
En este contexto, la Agencia recuerda que, no sólo las empresas de cobranzas son responsables, sino que también lo son las empresas que ceden los datos personales para el cobro de la deuda. Cuando una entidad cede a terceros la gestión de cobranzas o cualquier otro tratamiento de datos personales, no queda eximida de sus obligaciones. La normativa establece que el cesionario queda sujeto a las mismas obligaciones legales y reglamentarias que el cedente y es solidariamente responsable frente a eventuales incumplimientos.
En base a ello, la AAIP notificó a las entidades que podrían estar vinculadas con las prácticas investigadas, a fin de poner en su conocimiento la existencia del procedimiento en curso y recordarles las obligaciones legales que les corresponden, ya que, en caso de constatarse infracciones, la normativa prevé sanciones que pueden incluir multas, apercibimientos, suspensión, clausura o cancelación de bases de datos.
La AAIP continuará impulsando las actuaciones correspondientes para resguardar los derechos de las personas y prevenir prácticas de cobranza incompatibles con la protección de datos personales.
