What changed
The Louisiana Court of Appeal, First Circuit granted a supervisory writ and held that a trial court's order of protection granted under La. R.S. 46:2136 constitutes an appealable judgment. The court remanded the matter to the trial court with instructions to grant defendant Jacob Mansell an appeal following his notice of intent to seek supervisory writs, citing In Re Howard, 541 So.2d 195 (La. 1989) as authority.
For courts and legal practitioners, this ruling clarifies that protective orders are final appealable judgments under Louisiana law, entitling defendants to pursue appellate review. Parties involved in protective order proceedings should ensure compliance with this procedural framework when seeking review of such orders.
