Summary

The Louisiana Court of Appeal denied Derrick J. Cousin's application for postconviction relief as moot. The court noted that the district court had already denied the application and mailed the ruling to the applicant. The court provided instructions for any future filings.

What changed

The Louisiana Court of Appeal, First Circuit, has denied Derrick J. Cousin's application for supervisory writs related to his postconviction relief application. The court found the matter moot because the district court had previously denied the application on October 11, 2024, and the ruling was mailed to the applicant on February 24, 2026. The court cited Uniform Rules of Louisiana Courts of Appeal, Rules 2-18.7 & 4-9, indicating that supplementation or rehearing applications would not be considered.

For regulated entities, this decision signifies the finality of the district court's ruling on this specific postconviction relief application. While the court provided a deadline of June 22, 2026, for any new application to be filed without a return date, this is a procedural instruction for the applicant, not a compliance deadline for regulated entities. No specific actions are required from compliance officers, as this is a judicial matter concerning an individual's legal proceedings.
