Braggs v. San Diego Sheriff's Department, Dismissed
The US District Court for the Southern District of California dismissed a civil rights action filed by Michael Thomas Lekeith Braggs, a pro se inmate at the George Bailey Detention Facility in Santee, California. The plaintiff alleged excessive use of force during booking at San Diego Central Jail under 42 U.S.C. § 1983. The Court dismissed the First Amended Complaint on May 9, 2025, with instructions to file a Second Amended Complaint by June 20, 2025. As of the date of this order, no Second Amended Complaint was filed. The action was dismissed with final judgment entered and the file closed.
Christopher Dawel Gomez v. Jose De La Torre - Excessive Force Claim Partially Survives Motion Dismissal
The US District Court for the Southern District of California issued a Report and Recommendation granting in part and denying in part a motion to dismiss filed by defendant Jose De La Torre in Christopher Dawel Gomez v. Jose De La Torre, Case No. 23-cv-2026-WQH-DDL. The court recommended dismissing Gomez's state law claims (negligence and battery) because he failed to allege compliance with the California Government Tort Claims Act. However, the court recommended denying dismissal of Gomez's federal civil rights claims under 42 U.S.C. § 1983, which survived De La Torre's arguments regarding administrative exhaustion and the Heck doctrine. For affected parties, this means that while state tort claims may be barred without prior Government Claims Act compliance, constitutional claims against law enforcement deputies for alleged excessive force may proceed where sufficient factual allegations exist.
SEC v. Park - Civil Penalty Enforcement Order
The U.S. District Court for the Southern District of California granted the SEC's ex parte motion to enforce a civil penalty order under Section 21(e)(1) of the Securities Exchange Act of 1934. Defendant Chang G. Park failed to respond to a show cause order by the January 23, 2026 deadline. The court ordered the defendant to pay the civil penalty assessed against him plus interest accrued pursuant to 31 U.S.C. § 3717. The case is now closed.
