Jem Mixon v. Toyota Motor Corporation – Motion to Dismiss Denied

The US District Court for the Eastern District of Texas denied Toyota's Partial Motion to Dismiss and Motion to Strike Plaintiffs' Class Allegations, as well as Toyota's Motion for Judgment on the Pleadings based on statutes of limitations. The court rejected Toyota's arguments that plaintiffs' civil RICO and deceptive trade practices claims are time-barred, finding that plaintiffs plausibly alleged tolling doctrines apply. The denial preserves a nationwide class action and fourteen state subclasses alleging Toyota concealed a door lock actuator defect in multiple vehicle models.

Chanel Davis v. Frank Bisignano - Disability Benefits Remand

The US District Court for the Eastern District of Texas reversed the Social Security Administration Commissioner's denial of disability-insurance benefits to plaintiff Chanel Davis and remanded the case for further administrative proceedings. Davis, a 'younger person' at the time of application, claimed disability based on anxiety disorder, panic disorder, agoraphobia, and PTSD under 42 U.S.C. § 405(g). The court found the Commissioner's decision legally insufficient after reviewing the administrative record and the parties' briefs. The SSA must conduct further proceedings on remand consistent with the court's order.

Garcia-Delgado v. Experian - Motion to Exclude Expert Testimony Granted in Part

The United States District Court for the Eastern District of Texas partially granted Experian Information Solutions' motion to strike or limit expert testimony offered by plaintiff Ronald Alexander Garcia Delgado in this Fair Credit Reporting Act case. The court applied the 2023 amended Federal Rule of Evidence 702, finding the expert Douglas Hollon qualified and his testimony relevant, but requiring the proponent to demonstrate reliability 'more likely than not' under the heightened Daubert gatekeeping standard.
