Masciarelli v. NYC Department of Education - Religious Accommodation and COVID-19 Vaccine Mandate Dispute
The US District Court for the Eastern District of New York denied Plaintiff's Motion to Compel production of documents from non-party arbitrator Martin Scheinman related to DOE employee COVID-19 vaccine mandate arbitrations, finding it an improper collateral attack on arbitration awards. The Court granted Plaintiff's Motion to Amend the complaint. Plaintiff Lorraine Masciarelli, a Roman Catholic teacher, was terminated on September 5, 2022 for refusing the COVID-19 vaccine after her religious accommodation request was denied through both SAMS arbitration and the Citywide Panel appeals process.
Capricorn Management Systems v. Government Employees Insurance Co. - Motion to Dismiss Denied
The United States District Court for the Eastern District of New York denied GEICO's motion to dismiss for lack of subject matter jurisdiction. The court found that Capricorn Management Systems, Inc. did not untimely refile Count I, rejecting GEICO's argument that the six-month refiling window had lapsed. The decision allows Capricorn's breach of contract claim to proceed, resolving a procedural dispute that arose after years of prior litigation including summary judgment decisions and two separate appeals.
Nurses Association v. Brooklyn Hospital Center — TRO Denied, Jurisdiction Questioned
The US District Court for the Eastern District of New York denied a renewed TRO request by the New York State Nurses Association (NYSNA) in its suit against Brooklyn Hospital Center over alleged contractually required benefit fund contributions. The court found insufficient likelihood of jurisdiction under the Norris-LaGuardia Act, which generally bars federal injunctive relief in labor disputes, and questioned whether the union met the narrow Boys Markets exception for reverse injunctions. NYSNA is ordered to show cause by February 18, 2026 why the case should not be dismissed for lack of subject matter jurisdiction.
