Brunsen Burner Company v. GRP NM LLC - District Court New Mexico

The United States District Court for the District of New Mexico granted GRP NM LLC's Motion to Set Aside Clerk's Entry of Default and denied Plaintiffs' Motion for Default Judgment. The Court found that GRP NM's failure to respond resulted from a breakdown in service through its registered agent and did not constitute willful default under Rule 55(c) of the Federal Rules of Civil Procedure. Aaro v. Tri Star Freight System - Guardian Ad Litem Appointment

The United States District Court for the District of New Mexico granted a joint motion appointing Keith Franchini as Guardian Ad Litem (GAL) for the minor plaintiffs C.C. and S.C. in the wrongful death action Aaro v. Tri Star Freight System, Inc. Estate v. United States Government - Medical Negligence Summary Judgment

The Estate of Robert Lawrence Reynolds, through his widow Linda Lee Collier, brought suit against the United States Government alleging medical negligence and loss of consortium stemming from Reynolds' COVID-19 infection and subsequent death at the Veterans Affairs Medical Center in Albuquerque, New Mexico in 2020. The United States moved for summary judgment on the grounds that Collier had failed to retain a medical expert witness to support the negligence claim. The Court granted summary judgment in full, dismissing both the medical negligence and loss of consortium claims with prejudice.
