Sergio Mauricio Prada Munoz v. Director, U.S. Citizenship and Immigration Services — Motion to Dismiss Granted

The US District Court for the District of Nebraska dismissed Sergio Mauricio Prada Munoz's suit against the Director of U.S. Citizenship and Immigration Services, finding the court lacks subject matter jurisdiction over his claim. Prada Munoz, a Colombian national residing in Colorado, had petitioned for a U visa and work authorization and sought judicial relief to compel USCIS to adjudicate his applications within 14 days. The court concluded it cannot exercise jurisdiction over his APA claim because the governing statutory framework governing U visa work authorization grants the agency discretion rather than imposing a judicially enforceable duty.

NKOSI Inc. and John Ways v. United States - Habeas Corpus Petition Denied

The US District Court for the District of Nebraska denied NKOSI Inc. and John Ways's Petition for Writ of Habeas Corpus filed pursuant to 28 U.S.C. § 2255. The Court lacks jurisdiction because NKOSI is a corporate entity and not a prisoner in custody, while Ways cannot file a successive § 2255 motion without prior authorization from the Eighth Circuit Court of Appeals. Ways previously filed a § 2255 motion denied on February 21, 2023, and the Eighth Circuit affirmed that denial. The petition is dismissed in its entirety.

Riley Q. Linden v. Department of Health and Human Services (DHHS)

The United States District Court for the District of Nebraska dismissed pro se plaintiff Riley Q. Linden's civil rights complaint against the Nebraska Department of Health and Human Services on February 6, 2026. The Court found that claims arising from incidents in 2019 were barred by Nebraska's four-year personal injury statute of limitations, and that the complaint failed to state a plausible claim for relief under the federal pleading standards established in Bell Atlantic Corp. v. Twombly and Ashcroft v. Iqbal. The Court granted Linden leave to file an amended complaint regarding a 2024 SNAP benefits denial claim, which the Court indicated would be more properly analyzed under Title VI of the Civil Rights Act of 1964.
