ACProducts v. United States - Court Denies Motion on China WCV Duties

The US Court of International Trade denied a motion by ACProducts Inc. and affiliated cabinet manufacturers challenging Commerce's final scope determination covering wooden cabinets and vanities from China with further processing in Malaysia. The court sustained Commerce's determination that these products fell within the antidumping and countervailing duty orders. The ruling rejected arguments that Commerce improperly initiated the scope review and that the determinations lacked substantial evidence.

Blue Sky the Color of Imagination LLC v. United States - Planner Classification

The United States Court of International Trade granted the government's cross-motion for summary judgment and denied plaintiff Blue Sky the Color of Imagination, LLC's motion, ruling that the importer's weekly/monthly planners are properly classified as 'other' articles under HTSUS subheading 4820.10.40 rather than as calendars under heading 4910. This decision follows Federal Circuit reversal of an earlier CIT ruling that had classified the planners as diaries under subheading 4820.10.20. The classification determines applicable duty rates for imported planning products.

Cyber Power Sys. (USA) Inc. v. United States - Cable Tariff Classification

The US Court of International Trade granted in part and denied in part cross-motions for summary judgment in Cyber Power Systems (USA) Inc. v. United States, Court No. 21-00200. The court ruled that ten entries of electrical cables imported in 2019 through the Port of Minneapolis are properly classified under HTSUS subheading 8544.42.90 (2.6% ad valorem duty), reversing CBP's duty-free classification under subheading 8544.42.20. The cables also remain subject to Section 301 trade duties under subheading 9903.88.03 (10% or 25% ad valorem depending on entry date).
