Bankruptcy Court Denies Motion to Dismiss in NextGear Capital Floor Plan Loan Dispute
The United States Bankruptcy Court for the Western District of Texas denied Guillermo Garcia and Rocio Socorro Garcia's motion to dismiss NextGear Capital Inc.'s adversary complaint seeking to have $232,007.66 in floor plan loan debt declared nondischargeable under 11 U.S.C. §§ 523(a)(4) and (a)(6). The court held that the plaintiff adequately pled claims that a floor plan loan requiring proceeds to be held in trust may create fiduciary obligations, and that selling 24 financed vehicles without remitting proceeds may constitute willful and malicious injury. Because this procedural posture lacks sufficient evidence on the context and course of performance, the court declined to dismiss the complaint.
Miller v. Miller - Court Dismisses Lane Law Firm Claims, Remands to State Court
The United States Bankruptcy Court for the Western District of Texas dismissed claims against The Lane Law Firm, PLLC under Rule 12(b)(6) for failure to state a claim upon which relief can be granted, and remanded claims against debtor John Miller, Jr. and Haley Miller to state court for lack of subject matter jurisdiction. The court held that simply being a relative of the debtor is not enough to establish 'related to' jurisdiction under 28 U.S.C. § 1334, and permissively abstained from hearing claims against the debtor because they were intertwined with claims against Haley Miller.
Blackstone Claim Services Motion to Dismiss Ruling
The US Bankruptcy Court for the Western District of Texas issued an order partially granting and partially denying Blackstone Claim Services, Inc.'s Rule 12(b)(1) and 12(b)(6) Motion to Dismiss in Adversary No. 25-05084-CAG on April 2, 2026. The court held it has subject matter jurisdiction over McKee's 11 U.S.C. § 523(a) claims against Blackstone under 28 U.S.C. §§ 1334(b) and 157(a) as matters 'arising under' title 11. The court further found it lacks 'arising in' jurisdiction over McKee's state-law claims against Blackstone, though such claims may still affect the bankruptcy estate.
