In re John Papagno – Order Denying Motion for Reconsideration
On April 13, 2026, the US Bankruptcy Court for the Southern District of Florida entered an order denying debtor John Papagno's Motion to Reconsider the court's April 2, 2026 order regarding NOLA Lofts Condominium I. The court had previously found that NOLA violated the automatic stay by recording a post-petition lien but denied sanctions, holding that NOLA's in rem enforcement actions did not violate the discharge injunction. The court also declined to stay an impending tax sale of Papagno's property. The denial of reconsideration was based on Papagno's failure to identify any intervening change in controlling law, newly discovered evidence, or clear error of law or fact.
In re Pat McGrath Cosmetics LLC: Opt-Out Third-Party Releases Confirmed
The United States Bankruptcy Court for the Southern District of Florida confirmed the First Amended Plan of Reorganization of Pat McGrath Cosmetics LLC on April 21, 2026, approving opt-out third-party releases under Article VIII.C of the Plan. The Court ruled that the Holder Release mechanism constituted consensual release under federal bankruptcy law because the releases and opt-out opportunity were conspicuously disclosed in the Confirmation Hearing Notice, Ballots, and Disclosure Statement. The Court further held that parties who affirmatively voted to reject the Plan, were in a class deemed to reject the Plan, or checked the opt-out box do not grant the Holder Release. The confirmation hearing was held on April 13, 15, and 17, 2026.
Andrew Michael Demos - Pre-Filing Injunction Against Elaine Demos
The U.S. Bankruptcy Court for the Southern District of Florida granted Debtor Andrew Michael Demos's motion for a pre-filing injunction against his ex-wife Elaine Demos, prohibiting her from filing any further motions, pleadings, or papers without prior Court approval. Ms. Demos must now file a written 'Request for Leave to File' with the proposed filing attached and certify under penalty of perjury that the filing is made in good faith, is not repetitive of prior arguments, and is not intended to harass any party or burden the Court. The Court found that Ms. Demos filed seven orders in less than one month seeking substantially the same relief, with five designated as 'emergency' motions without following proper procedures, placing an unsustainable burden on chambers staff and causing Debtor to incur unnecessary legal fees.
