Christopher Joe Young Chapter 7 Homestead Exemption Ruling

The United States Bankruptcy Court for the Middle District of Florida overruled a creditor's objection to debtor Christopher Joe Young's homestead exemption claim. The creditor argued that the parsonage allowance funding Young's Orlando home came from Soul Quest Church's illegal ayahuasca operations, triggering the fraud exception to Florida's homestead exemption. The court held the fraud exception targets unjust enrichment, not punitive measures, and because Young received the parsonage as legitimate compensation rather than proceeds of fraud, the exemption stands. The underlying $15 million wrongful death judgment against the debtor arose from a retreat participant's death after consuming ayahuasca.

The US Bankruptcy Court for the Middle District of Florida issued a memorandum opinion and order resolving a dispute over whether the automatic stay protects a Chapter 11 debtor podiatry clinic from CMS recoupment of Medicare overpayments. The Court held that the automatic stay does not apply to CMS's right of recoupment of past overpayments, distinguishing its prior ruling in In re Bayou Shores SNF, LLC. However, the Court also held that the automatic stay does enjoin CMS, Treasury, and CBE Group from collecting Medicare overpayments or other debts from property of the estate, including the debtor's tax refunds.
