Nathan Lewis Fraud Debts Non-Dischargeable Bankruptcy Court
The US Bankruptcy Court for the Eastern District of Washington issued a memorandum opinion and order finding that debtor Nathan Lewis committed fraud and violated Washington's Consumer Protection Act by accepting substantial cash deposits from Tamara Baughn ($81,075.00) and from Jon Morrison and Orei Parker for home construction and renovation projects, then diverting those deposits to other projects and his struggling business rather than performing the contracted work. The court disregarded Farmhouse Legacy CoO., LLC's corporate form, concluding it was used to shield personal misconduct and obtain money by false representations. As a result, the debts owed to Baughn and to Morrison and Parker are nondischargeable under 11 U.S.C. § 523(a)(2)(A). The court declined to impose liability on Mrs. Lewis's separate estate.
