Roy Glenn Chapter 13 Kill Switch Stay Violation
Ed's Used Car Rental remotely disabled a Chapter 13 debtor's 2017 Nissan Rogue via kill switch on November 2, 2025, two days after the debtor filed for bankruptcy protection on October 31, 2025, despite being informed of the filing. The United States Bankruptcy Court for the Eastern District of Pennsylvania found that Ed's willfully violated the automatic stay under 11 U.S.C. § 362(k) and awarded damages, with the court noting that Ed's pattern and practice was to ignore and/or flout the bankruptcy stay, warranting punitive damages.
Good Works Housing LLC Chapter 11 Administrative Claim Ruling
In Good Works Housing LLC's Chapter 11 case (Bky. No. 25-12224), the Eastern District of Pennsylvania Bankruptcy Court granted Mercedes-Benz Financial Services USA LLC's motion for an administrative expense claim under 11 U.S.C. §§ 365(d)(5) and 503(b). The debtor failed to exercise any Lease End options by the August 1, 2025 deadline—60 days after the order for relief—and continued incurring post-petition vehicle lease obligations without assuming or rejecting the lease. Whitehall Trust Chapter 11 Motion Dismissed
The United States Bankruptcy Court for the Eastern District of Pennsylvania granted Secured Creditor Lehigh Valley 1 LLC's Motion to Dismiss the Chapter 11 cases of Whitehall Trust, Saucon Trust, Whitehall Manor, and Saucon Valley Manor (collectively, the Debtors). After an evidentiary hearing held on February 24, 2026, at which Debtors' principal Abraham Atiyeh testified, the Court determined that the Trusts were ineligible to be debtors under Section 109 of the Bankruptcy Code. The ruling affects entities considering Chapter 11 filings, particularly trust structures holding real estate assets.
