Marcus Nedd v. Bernadette Nedd - Chapter 13 Sanctions Ruling

The United States Bankruptcy Court for the Eastern District of New York issued a memorandum decision on Marcus Nedd's motion for sanctions and request for attorney's fees against former Chapter 13 debtor Bernadette Nedd, arising from the context of dismissing Ms. Nedd's Chapter 13 bankruptcy case and an underlying five-year matrimonial proceeding in New York Supreme Court. The court analyzed grounds for sanctions under Bankruptcy Code Section 523(a)(2)(A), its inherent authority, and Judiciary Code Section 1927, and assessed debtor good faith factors including filing timing, schedule completeness, Section 341 meeting appearance, and plan confirmation. The decision addresses the court's jurisdiction to impose sanctions independently of the underlying bankruptcy case status.
