What changed
The Court of Appeals of Georgia dismissed Tamera Montgomery's appeal against Milton Ruben Toyota of Augusta because Montgomery failed to file her brief within 20 days of the March 23, 2026 docketing date. The court applied Rule 23(a) to dismiss the appeal as abandoned.
Parties appealing Georgia trial court decisions must ensure appellate briefs are timely filed; failure to do so—even without a formal extension request—results in automatic dismissal of the appeal. Litigants should calendar all procedural deadlines and seek extensions proactively to avoid losing the right to appellate review.
