Swiss Patent Law 2027: Fee-Based Search and Examination Options
Summary
The partially revised Swiss Patent Law, expected to take effect on 1 January 2027, will introduce a fee-based search on the state of the art for every patent application filed from that date. Additionally, applicants will gain the ability to choose between a partial and a full substantive examination. The IPI has published FAQs on its website addressing which pending applications will be examined under current versus new legislation, with further updates pending the Federal Council's adoption of the Patents Ordinance.
“From then on, we'll carry out a fee-based search on the state of the art for every application.”

What changed
The partially revised Swiss Patent Law introduces two principal procedural changes effective 1 January 2027: (1) a fee-based search on the state of the art will be conducted for every patent application, and (2) applicants will be able to choose between a partial or full substantive examination. Questions regarding which pending applications will be governed by current legislation versus the new framework are addressed via FAQs published on the IPI website at www.ipi.ch/patents2027.
Patent applicants and their representatives filing in Switzerland from 1 January 2027 should budget for the new search fee and familiarise themselves with the examination option. Law firms and in-house IP departments handling Swiss patent filings should monitor the IPI page for updates, particularly following the Federal Council's adoption of the Patents Ordinance.
