Summary

The Karnataka High Court issued an order in the writ petition filed by Smt. P.N. Sudha against Sri. Govindaraju and Sri. Manoj Gowda M.L. The court addressed a preliminary objection raised by the respondents' counsel regarding the method of service of process.

What changed

This document details a writ petition filed in the Karnataka High Court concerning the validity of service of process. The petitioner, Smt. P.N. Sudha, seeks to quash an order that relied on uploading to ecourts/kiosk as equivalent to service or intimation under Order V of the Code of Civil Procedure, 1908. The respondents' counsel raised a preliminary objection.

The practical implication for legal professionals is to be aware of challenges to service of process methods, particularly those relying on electronic means. This case may set a precedent on what constitutes adequate service under Indian civil procedure, potentially requiring adjustments to how legal notices and summons are served and documented.

What to do next

  1. Review court orders regarding service of process, especially electronic methods.
  2. Consult legal counsel on potential challenges to service validity.
