What changed
This document is a court order from the Bombay High Court in India, specifically concerning Writ Petition No. 2371 of 2026, titled "Salim Sultan Ahmad Chaudhary v. The Appellate Tribunal for Parents and Senior Citizens, Nagpur and Others." The court heard arguments regarding an application filed by the petitioner, an over 80-year-old father, for eviction under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The original application was decided by the Sub-Divisional Magistrate, and an appeal was subsequently filed by respondent Nos. 2 and 3. The petitioner sought a direction for the Appellate Tribunal to hear and dispose of this appeal within a stipulated period.
The court's order directs the Appellate Tribunal to hear and dispose of the appeal. This implies that the petitioner's request for expedited resolution has been granted. The practical implication is that the Appellate Tribunal must now prioritize and process the pending appeal. While no specific compliance deadline is mentioned for the Tribunal's action, the order signifies a judicial push for timely resolution of cases involving senior citizens' welfare and rights under the relevant Act. Failure to comply with the court's direction could lead to further judicial intervention.
What to do next
- Direct the Appellate Tribunal to hear and dispose of Appeal No. 9/2025.
