David Bennett LaRoche - Public Censure for Professional Conduct Violations
Summary
The Tennessee Board of Professional Responsibility publicly censured attorney David Bennett LaRoche on April 7, 2026, for violating Rules of Professional Conduct 3.1, 8.1, and 8.4. The censure stems from LaRoche's failure to comply with a prior Private Reprimand, including refunding $500 to a complainant within 60 days and responding to Disciplinary Counsel. LaRoche's prior reprimand involved violations of competence, diligence, communication, and termination rules.
What changed
The Board issued a Public Censure against attorney David Bennett LaRoche for violating Rules of Professional Conduct 3.1 (meritorious claims and contentions), 8.1 (bar admission and disciplinary matters), and 8.4 (misconduct). This action was precipitated by LaRoche's failure to comply with a July 30, 2025 Private Reprimand, which had ordered $500 restitution to a complainant within 60 days. LaRoche neither refunded the money nor responded to lawful demands from Disciplinary Counsel.
Legal professionals in Tennessee should note that failure to comply with bar-imposed conditions can escalate from private reprimand to public censure, creating a permanent disciplinary record. Attorneys should ensure timely compliance with all Board-ordered conditions and maintain cooperation with Disciplinary Counsel investigations to avoid similar consequences.
What to do next
- Monitor for additional disciplinary actions if conditions remain unmet
- Ensure all client refunds ordered by bar authorities are completed timely
- Respond promptly to Disciplinary Counsel inquiries to avoid escalation
Penalties
Ordered to refund $500 to complainant (condition of prior Private Reprimand, still outstanding)

RUTHERFORD COUNTY LAWYER CENSURED
On April 7, 2026, David Bennett LaRoche, an attorney licensed to practice law in Tennessee, received a
Public Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.
Previously, Mr. LaRoche was issued a Private Reprimand and was ordered to refund his clientâs money.
Mr. LaRoche failed to meet the condition of his Private Reprimand and did not refund his client. Therefore, Mr.
LaRoche is being Publicly Censure for his failure to comply with the condition of the Private Reprimand.
On July 30, 2025, Mr. LaRoche was issued a Private Reprimand under TBPR Case No. 100906-2025-4-
MH-INV for violations of the Rules of Professional Conduct 1.1 (competence); 1.3 (diligence); 1.4
(communication); and 1.16 (declining or terminating representation). Additionally, as a condition of the Private
Reprimand, Mr. LaRoche was ordered to refund $500 to the Complainant within 60 days of issuance of the Private
Reprimand. Mr. LaRoche failed to refund the money and failed to respond to a lawful demand for information
from Disciplinary Counsel concerning this matter.
By these acts, Mr. LaRoche has violated Rules of Professional Conduct 3.1 (meritorious claims and
contentions), 8.1 (bar admission and disciplinary matters), and 8.4 (misconduct) and is hereby Publicly Censured
for these violations.
A Public Censure is a rebuke and warning to the attorney, but it does not affect the attorneyâs ability to
practice law.
