The following topics were considered by the Working Group during the eighteenth session. Electronic processing of international applications The Working Group agreed to submit amendments to Rules 4, 45bis, 92bis and 94 of the PCT Regulations for approval by the PCT Assembly at its session in July 2026, with the aim of improving electronic services and providing a higher degree of protection for personal data provided for PCT processing. The amendments will require the provision of an email address and a telephone number for processing an international application, allow the exclusion of certain personal data from public access, and provide a basis for changing the address to which correspondence is to be addressed later than 30 months from the priority date (refer to document PCT/WG/18/8 and Annex I to document PCT/WG/18/20). Establishing equivalent amounts of PCT fees The Working Group agreed to submit to the Assembly proposed modifications to Directives of the PCT Assembly relating to the Establishment of Equivalent Amounts of Certain Fees to streamline the process for establishing equivalent amounts and reduce the time between a fluctuation in an exchange rate and the entry into force of a new equivalent amount to reflect that fluctuation (refer to document PCT/WG/18/12 and Annex II to document PCT/WG/18/20). Proposal to transmit a copy of the notification of withdrawal (Form PCT/RO/136) to the applicant The Working Group approved, in principle, modifications to Section 326 of the Administrative Instructions and paragraph 322 of the PCT Receiving Office Guidelines which would provide a basis for receiving Offices that wish to do so, to inform the applicant of the processing status of a withdrawal request when the receiving Office transmits the notice effecting such withdrawal to the International Bureau (refer to document PCT/WG/18/10 and Annex III to document PCT/WG/18/20).

The session was suspended and will be resumed at a future date. Documents for the session are available at: https://www.wipo.int/meetings/en/details.jsp?meeting_id=89833 PCT Committee for Technical Cooperation The thirty-third session of the PCT Committee for Technical Cooperation was held in Geneva on 2 and 3 February 2026. The Committee discussed the application from the Mexican Institute of Industrial Property (IMPI) to be appointed as an International Searching Authority and International Preliminary Examining Authority (ISA/IPEA) under the PCT (see document PCT/CTC/33/27). The Committee also discussed the applications for extension of appointment of all 25 existing ISA/IPEAs, the periods of appointment of which will expire on 31 December 2027 (see documents PCT/CTC/33/2 to 26). The Committee agreed to recommend to the PCT Assembly the appointment of IMPI as an ISA/IPEA and the extension of appointment of all existing ISA/IPEAs. The Committee also approved a new format for the model agreement to be used as a basis for preparing the individual agreements that each Office or organization will have with the International Bureau in relation to its functioning as an ISA/IPEA from 1 January 2028. The new format for the agreement will no longer have separate annexes setting out the operational information for each ISA/IPEA; this information will be published in the Official Notices (PCT Gazette) and reflected in the PCT Applicant’s Guide. When approving the new format, the Committee agreed to submit to the Assembly amendments to the PCT Regulations necessary for use of the new format for the agreements (see document PCT/CTC/33/28). These amendments will be considered by the PCT Assembly in July 2026 when it decides on the appointment of IMPI and the extensions of appointment of existing ISA/IPEAs and, where appropriate, approves the individual draft agreements between each Office or organization and the International Bureau. | February|PCT User Survey reveals high satisfaction levels The PCT continues to offer a strong, consistent and highly valued service, according to WIPO’s most recent PCT user satisfaction survey, carried out in late 2025. Overall, 90% of respondents said they were either “very satisfied” (44%) or “satisfied” (46%) with the PCT-related services provided by WIPO – in line with previous survey results from 2023 and 2021, and a slight increase on the 88% satisfaction rating in 2019. The survey is conducted every two years as part of WIPO’s ongoing efforts to monitor and continuously improve customer satisfaction. The latest survey was made available in all 10 PCT publication languages during the final quarter of 2025 and received more than 1,700 responses. Respondents were invited to rate a range of services such as processing of PCT applications by the International Bureau (IB) (including in its capacity as receiving Office), ePCT functions and services, PCT information resources and training provided by WIPO. They also had the opportunity to provide text comments and suggest areas for possible improvement. The World Intellectual Property Report 2026: Technology on the Move draws on 250 years of historical data on technology use and five decades of patent data to explore changing patterns of technology diffusion. The report finds that new innovations are spreading much more rapidly than innovation in previous eras. The time between the invention of new technologies and their first use worldwide is shrinking, and the technology use gap between advanced economies and others is narrowing for more recent technologies – especially digital technologies. But while technologies are spreading across borders faster than ever, there remain many challenges in making technology diffusion work in developing economies and coordinated policy action is required to realize the full potential of new technologies. | February|PATENTSCOPE introduces verified SEP searches WIPO has enhanced its global patent database, PATENTSCOPE, with the addition of a new feature allowing users to search for verified standard essential patents (SEPs). The latest enhancement builds on “Declared SEPs” functionality introduced in 2025 which already enabled searches for patents that patentholders have declared as being potentially essential to a technical standard. The new feature takes that initiative a step further by identifying patents that have been objectively verified as SEPs by independent experts on behalf of a patent pool administrator. The first patent pool administrator to provide verified essentiality data is Sisvel. WIPO is engaging with stakeholders to further expand verified data sources. The GPPH makes it possible to request accelerated processing at any participating Office, based on work products (including, where applicable, a PCT written opinion from either the ISA or the IPEA, or an international preliminary report on patentability (IPRP) (Chapter II)) from any one of the other participating Offices, provided that at least one claim has been found to be patentable by the Office of earlier examination, and that any other applicable eligibility criteria are met. The pilot uses a single set of qualifying requirements and aims to simplify and improve the existing PPH network to make it more accessible to users. Note that, in order to be able to make use of the DAS service, the Office with which the earlier application was filed needs to be a DAS depositing Office – not necessarily the receiving Office with which the international application is filed.

Registration is open from 15 January 2026 to 12 December 2026 at: https://welc.wipo.int/acc/index.jsf Practical Advice Submitting amendments under PCT Article 34 after filing a demand for international preliminary examination Q: I would like to file a demand for international preliminary examination together with amendments to the description and drawings. The time limit to file the demand is about to expire. Is it possible to obtain more time to submit the amendments if they are not ready? A: International preliminary examination is an optional procedure that provides the only possibility during the international phase for an applicant to amend the description, claims and drawings of an international application. This possibility is provided by PCT Article 34, which also provides the right for an applicant to communicate orally and in writing with the International Preliminary Examining Authority (IPEA). The examiner at the IPEA will therefore be able to consider amendments and arguments submitted by the applicant, and this may give the applicant further opportunities to make amendments, as provided by PCT Rules 66.3 and 66.4, before the IPEA establishes the international preliminary examination report. By contrast, without filing a demand for international preliminary examination, an applicant has only one opportunity to amend the claims of an international application before the International Bureau under PCT Article 19, where the amended claims are published but not considered during the international phase. International preliminary examination is often referred to as the procedure under Chapter II, as it is governed by Chapter II of the PCT. The time limit to file a demand for international preliminary examination is either (i) three months from the date of the transmittal of the international search report (ISR) and the written opinion by the International Searching Authority (ISA) or (ii) 22 months from the priority date, whichever expires later (PCT Rule 54bis.1(a)). Generally, the IPEA may start international preliminary examination as soon as it is in possession of the demand, the fees due, the ISR and the written opinion of the ISA, provided that any translation required under PCT Rule 55.2 has been furnished. It is therefore advisable to file the demand and pay the applicable fees as soon as possible after you receive the results of the international search since the earlier the examination starts, the more time you will have to communicate with the examiner before the IPEA must establish its report. It is generally recommended to submit amendments and any arguments at the same time as filing the demand, noting that the IPEA need not take into account any amendments or arguments which it receives after it has begun to draw up its own written opinion or the report under PCT Rule 66.4bis). If your amendments are not ready when the time limit under PCT Rule 54bis.1(a) to file a demand is about to expire, and you wish the international preliminary examination to start on the basis of the amendments, it is important to ensure that at least the demand is filed within the

You should indicate in the demand that you wish the international preliminary examination to start on the basis of the description, claims or drawings as amended under PCT Article 34 (Box No. IV of Form PCT/IPEA/401). If no such amendments have in fact been submitted, the IPEA will invite you to submit them within a time limit fixed in the invitation (PCT Rule 60.1(g)) (using Form PCT/IPEA/431). The IPEA will not start examination before it has received the amendments, or before the time limit fixed in the invitation has expired (PCT Rules 60.1(g) and 69.1(e)). Please note that as this will delay the start of the examination, you may have less time to communicate with the examiner, noting that the IPEA must still establish the report within the time limit of PCT Rule 69.2, that is (where any required translation has been furnished together with the demand), 28 months from the priority date or 6 months from the start of the examination, whichever expires last. Note that all amounts are subject to change due to variations in the fees themselves or fluctuations in exchange rates. The international filing fee may be reduced by CHF 100, 200 or 300 where the international application, or part of the international application, is filed in electronic form, as prescribed under Item 4(a), (b) and (c) of the Schedule of Fees (annexed to the Regulations under the PCT) and the PCT Applicant’s Guide, paragraph 5.189. For non-residents of Kyrgyzstan, the equivalent amount of the fee can be paid in a freely convertible currency, in accordance with the exchange rate established by the National Bank of the Kyrgyz Republic and applicable on the date of payment. 20 The Japan Patent Office is competent only for IAs filed in Japanese or for which a translation into Japanese has been furnished under PCT Rule 12.3. 21 This fee includes value added tax (VAT) of 16%. 22 Plus, for paper filings: MYR 5 for one to ten pages, MYR 10 for 11 to 20 pages, MYR 40 for 21 to 50 pages, MYR 60 for 51 pages or more. 23 This fee is reduced by 50% where the applicant is a natural person. 24 Although there is no transmittal fee payable, the applicant must nevertheless pay the postage fee for the transmittal of the copy of the international application to the International Bureau and the International Searching Authority. 25 This fee is reduced by 90% where all applicants are also inventors and by 80% where all applicants are also non-profitable institutions and/or organizations. | February|PCT Contracting States and Two-letter Codes (158 on 1 February 2026) This Office has made a declaration under PCT Article 64(1)(a) and is not bound by Chapter II of the PCT.May only be designated for a regional patent (the “national route” via the PCT has been closed).3 Italy may be designated for a national patent only in international applications filed on or after 1 July 2020.4 Validation of European patent possible.For international applications filed before 1 October 2022, only an extension of a European patent is possible (there is no national phase before the Intellectual Property Office of Montenegro). International applications fi led on or after 1 October 2022 will include the designation of Montenegro for a European Patent.Where a State can be designated for a regional patent, the two-letter code for the regional patent concerned is indicated in parentheses (AP = ARIPO patent, EA = Eurasian patent, EP = European patent, OA = OAPI patent). Important: This list includes all States that have adhered to the PCT by the date shown in the heading. Any State indicated in bold italics has adhered to the PCT but will only become bound by the PCT on the date shown in parentheses; it will not be considered to have been designated in international applications filed before that date.
