What changed
The Texas Court of Appeals, 13th District, has dismissed the appeal in the case of Anderson & Associates Law Firm PLLC v. Hilliard Martinez Gonzales, LLP and Thomas J. Henry Injury Attorneys. The court's decision, issued on March 19, 2026, followed the appellant's failure to remit a $205.00 filing fee after being notified of the delinquency. The appeal was dismissed for want of prosecution, as per Texas Rule of Appellate Procedure 42.3 (b), (c).
This dismissal means the case will not proceed further on appeal. For legal professionals involved in appellate proceedings, this serves as a reminder of the critical importance of adhering to court filing fee requirements and responding promptly to court notices. Failure to do so can result in the dismissal of an appeal, as demonstrated in this case.
What to do next
- Ensure timely payment of all court-mandated filing fees in appellate cases.
- Monitor court notices and respond within specified deadlines to avoid dismissal for want of prosecution.
