Successful conclusion of second convergence of practice cycle

Following the Administrative Council's March meeting, new common practices on broad claims and double patenting have been adopted. This concludes the second cycle of the European Patent Office's (EPO) convergence of practice programme.

As a key initiative and a cornerstone of Strategic Plan 2028, the programme strengthens alignment and reduces divergences across the European Patent Network. By promoting more aligned and consistent practices, it boosts legal certainty for users and enhances synergies between first and second filing procedures.

The programme’s progress throughout 2025 has been driven by close co-operation between national patent offices, user associations, the World Intellectual Property Organization and the EPO.

Working Group 11 addressed the topic of Broad Claims. Its draft common practice outlines a comprehensive framework including a concept for overly broad claims and procedural options and approaches for handling such claims during the search phase. Working Group 12 advanced the topic of Double Patenting, developing a draft common practice that clarifies the information examiners should include when issuing a double patenting objection. This aims to ensure a more predictable and harmonised approach for applicants across the EPC contracting states.

Looking ahead

The programme's third work cycle is already underway (see CA/66/25 Rev. 1). Work has begun on the important topics of Divisional Applications and Internet Disclosures, with working groups established and questionnaires circulated to map national practices.

The convergence of practice programme continues to serve as a highly effective platform for building consensus on procedural matters, and co-operation within the new working groups is expected to be equally productive. The convergence of practice dashboard remains an essential tool in this process by offering a transparent overview of implementation progress. National patent offices are encouraged to continue updating their information to ensure the Dashboard remains an accurate, reliable resource for users.
