Summary

The DOJ Antitrust Division published a notice regarding changes to the membership of the Biopharmaceutical Manufacturing Preparedness Consortium (BIOMAP-CONSORTIUM). The consortium filed notifications disclosing new parties added to the group research project, which is intended to extend the National Cooperative Research and Production Act's provisions limiting antitrust plaintiff recovery to actual damages.

What changed

The Department of Justice's Antitrust Division has issued a notice regarding updates to the Biopharmaceutical Manufacturing Preparedness Consortium (BIOMAP-CONSORTIUM). This notice, published on March 26, 2026, follows a filing on October 8, 2025, where the consortium disclosed changes in its membership. Specifically, numerous new entities have been added to the consortium, including AGC Biologics, Anavatos Bio, Inc., Cidara Therapeutics INC, and many others from various domestic and international locations. These filings are made under the National Cooperative Research and Production Act of 1993 to ensure the consortium's activities continue to benefit from limitations on antitrust plaintiff damages.

For compliance officers, this notice is primarily informational. It confirms that the BIOMAP-CONSORTIUM is actively managing its membership under the specified antitrust provisions. No immediate action is required from regulated entities unless they are directly involved with or seeking to join the consortium. The notice indicates that membership remains open, and further updates are expected. The primary implication is that the consortium's activities will continue to be shielded from certain antitrust claims, provided all statutory requirements are met.
