The Federal Highway Administration (FHWA) is seeking Office of Management and Budget (OMB) approval for a new information collection regarding the National Review of Quick Clearance Laws. This initiative aims to gather data on state practices to improve traffic incident management and roadway safety. Public comments are requested by May 18, 2026.

What changed

The Federal Highway Administration (FHWA) has published a notice and request for comments regarding its intention to seek Office of Management and Budget (OMB) approval for a new information collection. This collection, titled "Update the National Review of Quick Clearance Laws," aims to develop a State of the Practice Report on Quick Clearance Laws to raise awareness, encourage adoption, and improve traffic incident management (TIM) programs. The eligible respondents include all 50 State DOTs, the District of Columbia, and Puerto Rico, with an estimated burden of 1 hour per respondent.

Regulated entities, specifically state Departments of Transportation, are invited to submit comments by May 18, 2026, on the necessity, accuracy of burdens, and potential methods to minimize the burden of this information collection. The FHWA will use these comments in its request for OMB clearance. This represents a new data collection effort focused on improving roadway safety and traffic flow through better incident management practices.

What to do next

  1. Review the proposed information collection regarding Quick Clearance Laws.
  2. Submit comments to FHWA by May 18, 2026, addressing the necessity, accuracy of estimated burdens, and potential burden minimization strategies.
