Summary

The U.S. International Trade Commission instituted Investigation No. 337-TA-1499 on April 9, 2026, based on a complaint filed by Archer Aviation Inc. alleging that imported electric aircraft, power systems, and components infringe five U.S. patents. The Commission will investigate whether these products violate Section 337 of the Tariff Act and whether a domestic industry exists as required by statute. Archer Aviation seeks a limited exclusion order and cease and desist orders.

What changed

The Commission instituted this investigation to determine whether imported electric aircraft, power systems, and components thereof infringe claims of U.S. Patents 11,945,594, 12,162,614, 8,469,306, 12,103,404, and 12,472,087, constituting a violation of Section 337. The investigation will examine whether a domestic industry exists as required by the statute.\n\nImporters and exporters of electric aircraft products accused of infringing these patents should prepare for potential exclusion orders and cease and desist orders if the Commission finds a violation. Companies should review their supply chains and patent portfolios to assess exposure to this investigation and consider filing public comments or motions to intervene.

What to do next

  1. Monitor the investigation proceedings and deadlines on EDIS
  2. Consult with patent counsel regarding any potential exposure to the patents listed
  3. Respond to discovery requests if involved in the investigation
