Summary
The Department of Commerce International Trade Administration published a notice under the Paperwork Reduction Act requesting public comment on Form ITA-338P, which nonprofit scientific and educational institutions use to apply for duty-free entry of imported scientific instruments under the Florence Agreement. The notice solicits comments on the information collection burden for approximately 90 respondents over the 60-day comment period.
What changed
The ITA published a Paperwork Reduction Act notice requesting public comment on Form ITA-338P, an information collection used to process applications for duty-free entry of scientific instruments and apparatus under the Florence Agreement. The form enables the Department of Homeland Security to verify statutory eligibility requirements and the Department of Commerce to assess scientific equivalency of comparable U.S.-manufactured instruments. Comments will be accepted for 60 days through June 9, 2026.
Affected parties including state and local governments, federal agencies, and not-for-profit scientific institutions should monitor this collection as it determines the paperwork burden for duty-free entry applications. The OMB Control Number is 0625-0037. Entities currently using or planning to use this duty-free provision should review the collection requirements and submit comments if they have concerns about the burden estimates.

SUPPLEMENTARY INFORMATION:
I. Abstract
The Departments of Commerce and Homeland Security (“DHS”) are required to determine whether nonprofit institutions established for scientific or educational purposes are entitled to duty-free entry for scientific instruments the institutions import under the Florence Agreement. Form ITA-338P enables: (1) DHS to determine whether the statutory eligibility requirements for the institution and the instrument are fulfilled, and (2) Commerce to make a comparison and finding as to the scientific equivalency of comparable instruments being manufactured in the United States. Without the collection of information, DHS and Commerce would not have the necessary information to carry out the responsibilities of determining eligibility for duty-free entry assigned by law.
II. Method of Collection
A copy of Form ITA-338P is provided on and downloadable from http://enforcement.trade.gov/sips/sipsform/ita-338p.pdf or the potential applicant may request a copy from the Department. The applicant completes the form and then forwards it via mail to DHS. Upon acceptance by DHS as a valid application, the application is transmitted to Commerce for further processing.
