Pickleball Paddles Section 337 Complaint; USITC Solicits Public Interest Comments
Summary
The U.S. International Trade Commission received a Section 337 complaint filed by Sport Squad, Inc. alleging patent and trade dress violations involving pickleball paddles against twelve respondents. The Commission is soliciting public interest comments on whether limited exclusion orders and cease and desist orders should issue if violations are found.
What changed
Sport Squad, Inc. filed a Section 337 complaint with USITC alleging that twelve pickleball paddle manufacturers and importers violated the Tariff Act of 1930 by importing and selling products that infringe on the complainant's patent and trade dress rights. The complaint requests limited exclusion orders to block infringing products from entering the United States, cease and desist orders against respondents, and imposition of bonds during the 60-day Presidential review period.
If the Commission finds a violation, respondents face potential exclusion orders that could block their pickleball paddle products from U.S. importation, cease and desist orders prohibiting domestic sales, and bond requirements during the review period. Domestic distributors and retailers should monitor this investigation as product availability disruptions may occur if exclusion orders issue. Any party with information on public interest implications should submit comments to USITC.
What to do next
- File public interest comments with USITC by the deadline
- Respondents should engage legal counsel regarding the complaint allegations
- Monitor USITC EDIS for complaint details and case developments
