Summary

Japan's METI has issued a cabinet order amending the Export Trade Control Order to add carbon dioxide streams for CCS (Carbon Capture and Storage) purposes to the list of goods requiring approval for export. The amendment implements Japan's obligations under the 1996 London Protocol, adding CO2 streams exported for disposal via sequestration to Appended Table 2. Exporters must obtain approval from the Minister of Economy, Trade and Industry, with enforcement beginning January 19, 2026.

What changed

The cabinet order adds carbon dioxide streams exported for CCS purposes to row (35-5) of Appended Table 2 of the Export Trade Control Order, making them controlled goods requiring Minister of Economy, Trade and Industry approval. The amendment aligns with the 2009 London Protocol amendment allowing CO2 export for offshore sequestration under certain conditions.

Exporters of CO2 streams for CCS purposes must now obtain approval before shipment, effective January 19, 2026. Affected parties include energy companies, industrial facilities, and CCS operators engaged in exporting carbon dioxide for geological storage. Companies should review their export activities and establish compliance procedures well before the enforcement date.

What to do next

  1. Identify if your exports include carbon dioxide streams for CCS purposes
  2. Apply for Minister of Economy, Trade and Industry approval before exporting CO2 streams for CCS
  3. Update export compliance procedures to include CO2 stream exports for sequestration

Penalties

Export without required approval violates the Foreign Exchange and Foreign Trade Act, subject to penalties including fines and imprisonment.

Cabinet Decision on the Cabinet Order to Partially Amend the Export Trade Control Order

Japanese November 14, 2025

External Economic Policy The Ministry of Economy, Trade and Industry (METI) implements export controls under the Foreign Exchange and Foreign Trade Act and the Export Trade Control Order (hereinafter referred to as the “Export Order”) based on the Act, for the purpose of fulfilling treaties and other international commitments.

With respect to the 1996 Protocol to the Convention on the Prevention of Marine Pollution by Dumping of Wastes and Other Matter, 1972 (the “London Protocol”), to which Japan is a contracting party, measures were introduced through the 2009 amendment to allow, under certain conditions, the export of carbon dioxide streams from carbon dioxide capture processes for sequestration (hereinafter referred to as “carbon dioxide streams for CCS purposes”). In May 2024, the Diet approved the acceptance of the amendment. As a domestic implementation measure, a cabinet decision was made today on the Cabinet Order to partially amend the Export Order to add carbon dioxide streams for CCS purposes to the goods listed in Appended Table 2 of the Export Order.

1. Outline of the amendment

From the perspective of fulfilling treaties and other international commitments, an amendment will be made to add the following item to row (35-5) of Appended Table 2 of the Export Order as goods requiring the approval of the Minister of Economy, Trade and Industry for export:

  • Carbon dioxide streams as provided for in paragraph 1.7 of Annex 1 to the 1996 Protocol to the Convention on the Prevention of Marine Pollution by Dumping of Wastes and Other Matter, 1972, that is exported for the purpose of disposal as provided for in paragraph 4.1 of the same Annex
